DMCA Copyright Policy

Welcome to Ceuline (accessible via https://ceuline.com). Ceuline respects the intellectual property rights of creators, designers, and copyright owners worldwide. In compliance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512, we have established clear structural procedures to handle claims of copyright infringement occurring on our digital storefront.

As an online retailer of fine jewelry—including custom Bracelets, delicate Earrings, statement Necklaces, and detailed Rings—all original content, imagery, and product designs featured on our storefront are heavily protected by copyright laws. Likewise, we take allegations of unauthorized material placement very seriously and will expeditiously remove verified infringing content upon receiving a valid notification.

1. Filing a Notice of Copyright Infringement

If you believe that your copyrighted work or jewelry design has been copied, adapted, or displayed on our platform in a manner that constitutes copyright infringement, you must submit a written Takedown Notice to our designated Copyright Agent. To ensure compliance with federal legal structures, your notice must contain the following information:

  • Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the Copyrighted Work: Clear description of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  • Identification of the Infringing Material: Direct identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the exact URLs (web links) to ensure our compliance team can locate the item.
  • Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, physical mailing address, telephone number, and direct email address.
  • Good Faith Statement: A formal statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Perjury Declaration: A statement that the information in the notification is highly accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. DMCA Enforcement Framework

Upon receiving a comprehensive and structurally valid DMCA Takedown Notice, Ceuline will handle the administrative review within a strict chronological timeline:

Operational Action Enforced Compliance Protocol
Expeditious Removal We immediately deactivate, take down, or block public access to the specific product listings, photography components, or text links identified in the valid notice.
Supplier Notification We take reasonable steps to promptly notify our affected staff, supply network, or content contributors that we have removed access to the material.
Repeat Infringer Policy In accordance with standard legal structures, we maintain a strict repeat-infringer policy. We will permanently terminate all system access for any internal supplier or contributor verified to have repeatedly violated intellectual property rights.

3. Filing a DMCA Counter-Notification

If your material was mistakenly removed or disabled as a result of a misidentification or administrative error, federal law permits you to file a formal Counter-Notification with our designated agent. To be structurally effective, a Counter-Notification must be a written communication that contains the following criteria:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, along with the specific URLs before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your full name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside the United States, that you consent to the jurisdiction of the Federal District Court in Dallas County, Texas), and that you will accept service of process from the person who provided the original infringement notification.
Legal Precaution Notice: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or was removed by mistake or misidentification, may be held liable for substantial financial damages, court costs, and reasonable attorneys' fees incurred by the alleged injured party or by Ceuline.
